People v. J.H (2012) Torrance
In 2011, police officers entered Client’s home unannounced and without a warrant. They claim they were investigating a burglary but there was no signs of forced entry or forced entry. Officers went through the entire home until they found the Client tending to his legally operating medical marijuana grow operating in his backyard. Police officers arrested the Client, demolished the grow operation, and put all equipment into storage.
On a motion to suppress, a judge found that the police officers made an illegal search and seizure of Client’s home. The judge ordered all the evidence suppressed and therefore unusable by the District Attorney’s office - leaving the District Attorney only one option: dismissal. As part of the dismissal, the Client received all of his grow equipment back.
I received supression of evidence but Siskiyou county still took this to trial.how can they do that I thought if the judge throws out the supression of evidence then they would have to dismiss the case .but now in Siskiyou county.they just send out the task force to raid me on OR release search..look this one up you’ll love how the Siskiyou county does not follow any rules.they make them up as they go to trial..how can the DA keep the jury from hearing evidence in the original incursion onto my parents property.. my mom has a 600,000.00 dollar lawsuit against these officers but Siskiyou county told here she didn’t file in a timly fassion.so they trying again to proceed with these litigation against officer Ben Grossman..J James Johnson is my moms attorney I in Yreka .look this case up call me at 541-499-2037 tell me what you think..how do I file for mistrial..
