COMMUNITY SERVICE FOR SEVEN POUNDS

Defendant transporting seven pounds of marijuana (with admissions of illegal sales at traffic stop) will be sentenced to only a misdemeanor offense and community service if he obeys all laws for two years.

30-POUND CASE DISMISSED FOR DISPENSARY OWNERS

Defendants were dispensary owners and were charged of possession and sales of marijuana over 30 pounds. Case was dismissed at pre-trial stage on the eve of trial pursuant to People’s Motion to Dismiss in the Interests of Justice.

Acquittal at jury trial of DUI case where defendant refused blood alcohol test and allegedly told police he would not do it because of his prior DUI.

SIX-POUND CULTIVATION CASE DISMISSED

2007 CASES

NOT GUILTY VERDICT FOR ASSAULT WITH WEAPON

At jury trial, where defendant was charged with brandishing a weapon, criminal threats with a gun, and assault with a deadly weapon, defendant was found not guilty of all counts including weapon except criminal threats. Jury also found defendant to be out on bail during offense. Defendant also was charged in Riverside County with felony evading arrest and misdemeanor weapons charge. Defendant served one year in state prison, and his exposure between his two cases was approximately 15 years.

FELONY POSSESSION DISMISSED

Dismissal with Narcotics Anonymous classes for felony possession of cocaine charge for noncitizen defendant facing deportation if convicted.

CULTIVATION CONVICTION OVERTURNED BASED ON TRIAL ARGUMENT

After the prosecution dismissed a possession for sale count after a hung jury (tried by counsel) on that count, the conviction for cultivation was overturned at the Court of Appeals; counsel had argued that jury instruction given on medical marijuana plant numbers was unconstitutional.

Defendant was charged with cultivating 150 marijuana plants; case dismissed by the prosecution in the interests of justice; return of all property in evidence, including the medical marijuana. Case re-filed after defendant re-cultivated at same location, and he is still fighting.
