NOT GUILTY VERDICT FOR ASSAULT WITH WEAPON

At jury trial, where defendant was charged with brandishing a weapon, criminal threats
with a gun, and assault with a deadly weapon, defendant was found not guilty of
all counts including weapon except criminal threats. Jury also found defendant to
be out on bail during offense. Defendant also was charged in Riverside County with
felony evading arrest and misdemeanor weapons charge. Defendant served one year
in state prison, and his exposure between his two cases was approximately 15 years.
FELONY POSSESSION DISMISSED

After the prosecution dismissed a possession for sale count after a hung jury (tried
by counsel) on that count, the conviction for cultivation was overturned at the
Court of Appeals; counsel had argued that jury instruction given on medical marijuana

Defendant on federal habeas corpus appeal of allegedly over 1,000 marijuana plants,
certified for appeal to the Ninth Circuit Court of Appeals. Counsel appealed to
U.S. Supreme Court.
